The Amended Federal Expert Witness Rule: FRE 702.

Abstract

Federal Rule of Evidence 702 (FRE 702), "Testimony of Expert Witnesses," applies to all expert opinion testimony in federal court cases. In 2023, FRE 702 was amended to require more rigorous screening of expert testimony and a finding that by a preponderance of the evidence the proffered testimony is based on reliable principles and methods, is based on sufficient facts and data, and the expert's opinion reflects a reliable application of the principles and methods to the facts of the case. This amended rule specifies a new level of scrutiny of expert opinion testimony following decades of conflicting interpretation by federal courts and different appellate courts of the Daubert case standard that required a judicial determination of the reliability and use of generally accepted methods underlying expert opinion testimony.
