Abstract

This article focuses on recent legal developments in sports and gaming litigation. It first discusses the dismissal without prejudice of a defamation claim by Whitney against D.C. United concerning an alleged Nazi salute gesture, emphasizing that the club’s statement was deemed an opinion not provably false. The article then details Nintendo’s successful default judgment against streamer Jesse “EveryGameGuru” Keighin for copyright infringement and trafficking in circumvention tools related to unauthorized pre-release livestreaming of Nintendo Switch games, highlighting the court’s injunction and damages award. Lastly, it summarizes the Sixth Circuit’s affirmation that the University of Kentucky did not violate Title IX by failing to provide sufficient varsity athletic opportunities for female students, noting the court’s reliance on evidence of unmet interest and ability in the relevant sports.
