Adventures in the Law: Justice for Ham Sandwiches?

Abstract

The article focuses on a unique legal case in which a man, referred to as Mike, was charged with assault after throwing a sandwich at a federal officer in Washington, D.C. Despite the U.S. Attorney’s efforts, a grand jury refused to indict Mike on felony charges, and he was later acquitted of misdemeanor assault after a trial. The case challenges the long-standing legal notion attributed to New York Court of Appeals Chief Judge Sol Wachtler that prosecutors can easily secure indictments, illustrating that grand juries may sometimes reject such charges.
