Abstract

This article focuses on the Journal of Intellectual Property Law & Practice’s (JIPLP) 2024 special issue dedicated to the relationship between fashion and intellectual property (IP) law. It highlights recent developments in fashion law scholarship, including discussions on blockchain for product authentication, historical parallels in design copying, copyright protection of fashion and food art, EU copyright case law, emerging regulatory frameworks like Digital Product Passports, and the impact of digital technologies such as Artificial Intelligence. The issue underscores ongoing challenges in defining appropriate IP protection for fashion, difficulties in enforcement, and the growing role of technology-based solutions in addressing these issues.
