Abstract
The article examines the conditions whereby the fraud or concealment exception to the statute of repose found in Title 29 of the U.S. Code section 1113 for alleged breaches of an Employee Retirement Income Security Act of 1974 (ERISA) are applicable. Topics include the differential opinion amongst the federal circuits, analysis of the current state of case law, statutory interpretation and reasons why some court opinions are subject to reductio ad absurdum.
