Abstract

The US Supreme Court recently ruled unanimously that Donald Trump can appear on presidential ballots this year. However, beneath the surface, there was significant discord among the justices. Three liberal justices expressed their dissatisfaction with the ruling, criticizing their conservative colleagues for blunting the constitutional provision that bars insurrectionists from holding public office. The opinion, which was labeled as a concurring opinion but read more like a dissent, quoted Chief Justice John Roberts and took a direct shot at him. Despite the divisions, all nine justices agreed that states cannot enforce the insurrection clause by barring federal candidates from the ballot. [Extracted from the article]
