Abstract
The article focuses on the challenges and legal complexities of applying the First Amendment's free speech protections to modern Internet communications, including social media. It outlines how foundational legal precedents were established in eras dominated by newspapers, radio, and early broadcasting, and have not kept pace with the scale, speed, and nature of digital communication today. Key issues discussed include government censorship limits, the role of private gatekeepers like social media companies, protections for hate speech and fake news, privacy concerns, and the impact of algorithms on information dissemination. The article concludes with suggestions for updating legal frameworks, proposing that Internet service providers and social media platforms be regulated as public service providers under federal oversight to better address harms while preserving free speech rights.
