Abstract

The article discusses the recent revival of interest in the concept of constituent power, which refers to the right of "We the People" to shape their constitutional orders. The author highlights two books that contribute to this field of research by offering new reconstructions of historical ideas and events related to constituent power. One book focuses on the role of constituent power within established constitutional orders, while the other explores the diverse interpretations of constituent power throughout history. Both books aim to bring more clarity and understanding to the concept of constituent power. The article also discusses the distinction between constituent power and sovereignty, as well as the potential applications of constituent power in a globalized world. The author raises questions about the process of opinion and will formation in relation to constituent power and suggests further examination of the relationship between popular sovereignty and constituent power.
