Abstract

This article examines the judicialization of health care in Uruguay, focusing on the role of the Supreme Court of Justice (SCJ) in reviewing the constitutionality of laws regulating access to high-cost medicines (MAC). Despite Uruguay’s robust health system and a traditionally deferential SCJ, the Court’s interpretation of relevant legal provisions has shifted through three distinct stages between 2016 and 2022, alternating between activist and deferent stances while consistently adopting an interpretativist approach. These shifts correspond with frequent changes in the Court’s composition and reveal the coexistence of diverse legal cultures within the tribunal. The study highlights the complexity of judicial involvement in social rights, the evolving legal reasoning of the SCJ, and the implications of judicial decisions on health policy and equity in Uruguay.
