Abstract

The article focuses on the pursuit of monetary reparation by victims of war in Bosnia and Herzegovina (BH) as a means to acknowledge and repair historical injustices and mass harms caused by genocide during the 1991–1995 conflict. Drawing on qualitative ethnographic research and archival data, it examines how victims—including war camp survivors, victims of sexual violence, and parents of murdered children—use civil litigation to claim compensation for non-pecuniary damages such as injury to body, dignity, and family loss, amid a fragmented post-war political and legal landscape. Despite challenges like limited state support, ethnic divisions institutionalized by the Dayton Peace Agreement, and difficulties in executing court judgments, monetary reparation has gained social and symbolic value as a form of legal recognition, retributive justice, and a tool to highlight ongoing civil and political exclusions. The article argues for a victim-centered reconceptualization of reparation that incorporates victims' voices to better address both past harms and present socio-economic marginalization within Bosnia's transitional justice framework.
