Abstract
The article examines the legal barriers that prevent musicians from blocking politicians' use of songs at U.S. campaign rallies despite high-profile disputes. Topics include antitrust consent decrees governing Performing Rights Organizations (PROs) that prohibit selective song withdrawals, the rejected trademark claims in cases such as Oliveira v. Frito-Lay, and the absence of copyright-based express exclusive right to control the association of a copyrighted musical work with another person.
