Abstract

The Federal Court of Canada has ruled that Prime Minister Justin Trudeau's use of emergency legislation to quell protests in 2022 was not justified. The court stated that there was no national emergency that warranted the invocation of the Emergencies Act, and that the decision to do so was unreasonable. Trudeau's government used the law to block the flow of money and supplies to protesters who were opposing Covid-19 restrictions and vaccine mandates. The government argued that the protests had turned into an illegal occupation and that the act was necessary, but the court determined that the situation could have been dealt with under existing laws.
