Abstract
This article analyzes the reform of secured transactions law in selected Asian jurisdictions in relation to modern principles embodied in model laws such as the UNCITRAL Model Law on Secured Transactions and personal property security statutes based on Article 9 of the US Uniform Commercial Code. It highlights that while most jurisdictions in Asia have undertaken reforms over the past two decades to align their laws with these modern principles, the degree of conformity varies due to differing legal traditions, reform motivations, and institutional factors. The article discusses how both civil law and common law traditions present challenges to adopting the modern principles but notes that legal culture is not an insurmountable barrier, as evidenced by diverse reform outcomes across jurisdictions. It also emphasizes the role of international benchmarks, such as the World Bank's Doing Business report, and external influences in shaping reform efforts, concluding that jurisdictions tailor reforms based on their unique needs and circumstances.
