Abstract

The article focuses on the evolving challenges in competition law enforcement and the ongoing debate about its goals and standards. It highlights how recent developments in digital markets, labor markets, and environmental sustainability have complicated traditional competition law frameworks, particularly the consumer welfare standard. The lack of clear, consistent goals and standards across jurisdictions creates legal uncertainty for enforcers, policymakers, and market participants. The article argues that policymakers should clarify or redefine the objectives and application standards of competition law to address these complexities and ensure democratic legitimacy and legal predictability.
