REASSESSING THE CONSTITUTIONALITY OF SEC ADMINISTRATIVE PROCEEDINGS IN VIEW OF JAPANESE ADMINISTRATIVE PROCEEDINGS.

The article explores the constitutionality of the administrative proceedings being conducted by the U.S. Securities and Exchange Commission (SEC). Topics discussed include a comparison between the administrative and civil proceedings of SEC, the sanctions which may be sought by SEC in proceedings presided by an administrative law judge, and a brief overview of the administrative investigations being conducted by the Japanese counterpart of SEC.
