Abstract

The article explores the constitutionality of the administrative proceedings being conducted by the U.S. Securities and Exchange Commission (SEC). Topics discussed include a comparison between the administrative and civil proceedings of SEC, the sanctions which may be sought by SEC in proceedings presided by an administrative law judge, and a brief overview of the administrative investigations being conducted by the Japanese counterpart of SEC.
