Exploring Sunset Clauses on NIL Contracts.

Abstract

This article explores the impact of Sunset Clauses on Name, Image, and Likeness (NIL) contracts for college athletes. Seven states, primarily in the SEC, have implemented mandatory Sunset Clauses to govern the length of NIL contracts. However, there are legal uncertainties and potential loopholes surrounding these clauses, such as the definition of "participation" and when the Sunset Date commences. These ambiguities can lead to expensive litigation and unfair outcomes for athletes and brands. The author recommends either removing Sunset Clauses altogether or clarifying their terms to ensure fairness and protect student athletes. Extracted from the article
