Red States and Coal Groups Fight Biden Power Plant Rule.

Abstract

More than two dozen states, rural power companies, and coal advocates have filed lawsuits challenging a new Biden administration rule that aims to reduce greenhouse gas emissions from US power plants. The lawsuits argue that the rule is an unlawful attempt to reshape the nation's electricity system. West Virginia, a major coal producer, is leading a 25-state coalition in one of the challenges, claiming that the Biden administration is defying a Supreme Court ruling and setting up power plants to fail. The new rule requires coal plants to capture most of their carbon dioxide emissions or shut down by 2039, and similar pollution cuts for new gas-fired plants. Other challenges have been filed by the National Rural Electric Cooperative Association, the National Mining Association, and America's Power. The Edison Electric Institute has criticized the rule's reliance on carbon capture technology, stating that it is not ready for wide-scale deployment. The Natural Resources Defense Council supports the rule, arguing that it embraces proven technology for cleaning up power plant pollution.
