Abstract
This article examines the role and hiring practices of legal counsel for PK-12 school districts within the current sociopolitical climate, emphasizing the intersection of law, education, and commitments to equity, diversity, and inclusion (DEI). It highlights that while attorneys are critical in guiding school districts through complex legal and political challenges—such as curriculum restrictions and civil rights issues—job postings often prioritize general legal expertise over specialized knowledge in education law or explicit engagement with DEI and the political context. The study suggests that school districts and law firms should refine hiring criteria to seek attorneys with deep education law expertise, interdisciplinary collaboration skills, and a demonstrated commitment to advancing equity and resisting restrictive legal interpretations that undermine DEI goals. This research underscores the importance of legal counsel as proactive partners in supporting school districts' missions amid politically charged environments.
