Abstract

The article focuses on recent legal developments concerning student-athlete rights and school athletic participation policies. It details an appeal involving Kayden Zoeller, whose informal bullying complaints were initially unrecognized due to lack of formal documentation, but were ultimately validated by an appeals board emphasizing the importance of early, written reporting. Additionally, a federal court ruled that a Pennsylvania school district’s exclusion of parochial students from interscholastic athletics, while allowing homeschooled and charter school students to participate, violated the Free Exercise Clause of the First Amendment and the Equal Protection Clause of the Fourteenth Amendment; this led to a consent order permitting parochial student participation under certain conditions. The article also notes a similar ongoing lawsuit against the Pennsylvania Interscholastic Athletic Association (PIAA) challenging comparable exclusionary policies.
