Content Independence and Political Obligation: Scope Limitations of Content-Independent Moral Reasons.

Abstract
The article critically examines the traditional view of political obligation as content-independent (CI)—the idea that citizens have a moral duty to obey all laws simply because they are laws, regardless of their specific content. It argues that this view cannot be adequately justified due to "scope limitations," meaning that single moral principles commonly invoked (such as fair play or natural duties of justice) fail to ground obligations to obey the full range of laws typically considered legitimate. The author proposes a modified hybrid approach that preserves content independence by combining multiple scope-limited CI moral reasons, each justifying obedience to particular laws or classes of laws rather than all laws universally. While this approach is more complex and less elegant than traditional theories, it offers a defensible framework for understanding political obligations in diverse legal and moral contexts.
