Abstract

The regulation of coal ash (or coal combustion residuals) is a significant step in public health and environmental protection because its disposal affects groundwater quality. Additionally, the rule sets out recordkeeping and reporting requirements and established technical requirements for CCR landfills and surface impoundments under subtitle D of the Resource Conservation and Recovery Act (RCRA) and recycling of CCRs through safe, beneficial use (USEPA [13]). The latest 2023 proposed rule would close a loophole in the CCR regulations that exempted inactive impoundments at inactive facilities from meeting the same standards as other unlined impoundments at active facilities (USEPA [7]).
