Abstract
This article focuses on the role of psychiatric care in supporting unstably documented migrants and asylum seekers in Japan by enabling them to obtain medically certified claims of psychological distress, which facilitate legal pathways to social protection. Research conducted through ethnographic fieldwork at a psychiatric clinic and shelter in Tokyo reveals how psychiatric intervention intersects with legal processes, allowing multi-ethnic provisional release permit (PRP) holders to articulate their detention experiences and legitimize their claims for rights. Psychiatric medicalization thus creates a conceptual space that aids in the legal recognition of mental illness, which is crucial for maintaining provisional release and deferring detention or forced repatriation.
