Abstract

The article discusses a recent decision by the Fifth Circuit Court of Appeals regarding the intersection of Title VII's prohibition against discrimination based on sexual orientation and gender identity and religious freedom protections. The case involved two employers in Texas who had policies that discriminated against homosexual and transgender conduct based on their religious beliefs. The court held that the employers were entitled to an exemption from Title VII under the Religious Freedom Restoration Act, as compliance with Title VII would substantially burden their religious beliefs.
