Abstract
This article focuses on the neuropsychological and cultural factors involved in assessing Competency to Stand Trial (CST) through a case study of a 62-year-old African-born male physician charged with health fraud. Comprehensive forensic, neuropsychological, and neurological evaluations revealed Mild Neurocognitive Disorder with multiple etiologies, including moderate brain atrophy and cognitive impairments affecting reasoning and memory. These deficits were causally linked to the individual’s inability to competently understand legal proceedings or collaborate with counsel, leading to a legal determination of incompetency to stand trial with low likelihood of restoration. The study highlights the importance of thorough neuropsychological assessment in complex legal cases involving cultural considerations and brain pathology.
