The Rise in the Participation of Asia Pacific States in the Proceedings of the International Court of Justice (2010-2023).

Abstract

The article focuses on the recent and historically unprecedented rise in participation by Asia Pacific States, members of the United Nations Asia Pacific Group (UNAPG), in proceedings before the International Court of Justice (ICJ) from 2010 to 2023. It highlights that eighteen contentious cases involving UNAPG members have been filed in this period, representing over half of all such cases involving the region since 1946, with participation concentrated mainly in the East Asia and Middle East sub-regions, while Central Asian States remain largely absent. The article also notes a significant increase in advisory proceedings participation by Asia Pacific States, including China and Pacific Island nations, particularly in landmark cases such as the advisory opinion on Obligations of States in Respect of Climate Change. Through a regional and sub-regional analytical lens, the study underscores diverse patterns of engagement shaped by cultural preferences, political considerations, and strategic litigation, while acknowledging ongoing limitations such as low acceptance of the ICJ’s compulsory jurisdiction among many Asia Pacific States.
