Everything but the Marriage Certificate: Unmarried Partners in Norwegian Immigration Regulation.

Abstract

This article examines the regulation of family immigration for unmarried partners in Norway from the 1980s to the present, highlighting tensions between evolving societal norms around intimate relationships and restrictive immigration controls. Despite Norway's legal recognition of unmarried cohabitation and same-sex partnerships, immigration rules require documented cohabitation of at least two years or marriage, creating barriers for many couples, especially those unable to marry or prove cohabitation due to legal or social constraints in their countries of origin. The article analyzes three sites of contestation—the Liberal Party's proposal for a "love visa," applicants' personal statements in immigration cases, and critiques from queer civil society organizations—demonstrating how appeals to contemporary intimacy norms confront a dominant state logic prioritizing control and prevention of "problematic marriages." The findings reveal that while intimate norms have liberalized, immigration regulations remain anchored in control imperatives, resulting in incomplete recognition of unmarried partners in family migration policy.
