Abstract
• Length and complexity of trial-A trial dedicated solely to the statute of limitations will likely be significantly shorter than a full trial, particularly in pharmaceutical products liability cases. A trial solely on the issue of the statute of limitations allows defendants to have a streamlined, efficient trial that avoids the seeming contradiction between defending against liability and forcefully asserting a statute of limitations defense.
