A "third camp" in Israel's constitutional upheaval: The voice of the silent Palestinian-Arab minority.

Abstract

The article focuses on Israel's 2023 constitutional crisis triggered by a government-led judicial reform initiative aimed at curbing the powers of the Israeli Supreme Court (ISC). It highlights the emergence of three distinct camps in the debate: the pro-reform camp seeking to strengthen executive control, the anti-reform camp defending the existing judicial balance, and a "third camp" formed by the Palestinian-Arab minority. Despite being a primary stakeholder due to their vulnerable political status, the Palestinian-Arabs largely abstained from protests, viewing the reforms as a marginal adjustment to a constitutional order that has long marginalized them through an endemic "democratic deficit" characterized by an overly powerful government and legislature. The article further explores how this minority has engaged in "resistance litigation" to challenge systemic inequalities and asserts that the 2023 upheaval presents a potential constitutional moment for reexamining Israel's legal and societal structures, with the Palestinian-Arab minority positioned uniquely both inside and outside the constitutional order.
