Abstract
This article focuses on the evolving relationship between Colombia and the International Criminal Court (ICC), particularly analyzing the ICC's Office of the Prosecutor's (OTP) assessment of Colombia's transitional justice efforts from 1998 to 2022. It examines how the ICC's longest preliminary examination, opened in 2004 and closed in 2021 through a Cooperation Agreement, influenced Colombia's peace process and justice mechanisms, notably the Special Jurisdiction for Peace (SJP). The article highlights the ICC's shift toward accepting restorative, non-custodial sanctions as compatible with international standards of criminal responsibility in transitional contexts, marking a departure from earlier expectations of imprisonment for serious crimes. It also discusses the ICC's role in shaping Colombia's peace negotiations and the ongoing challenges related to victims' participation and the practical implementation of restorative justice measures.
