Miami Heat Defeats Motion to Dismiss in 'Culture' Trademark Litigation.

Abstract

The article focuses on a trademark litigation case in which the Miami Heat Limited Partnership successfully defeated a motion to dismiss counterclaims against Joel Pena, a fashion designer who sued the team for trademark infringement related to the marks "CULTURE" and "CULTURE TV." The U.S. District Court for the Southern District of New York held that Miami Heat sufficiently alleged priority and senior use of the marks since 2015, as well as abandonment by Pena due to non-use from 2017 to 2024, supporting claims for declaratory judgment and cancellation of Pena's federal and state trademarks. The court also found that Pena's alleged false statements regarding use in trademark applications could constitute fraud, while issues such as likelihood of confusion were deemed fact-intensive and inappropriate for dismissal at this stage. The decision reaffirms that trademark rights in the U.S. are based on actual use rather than registration alone.
